Rule 5 - The Protection of Our Surface Water by Controlling Pollutants From Construction Sites
The revision to Rule 5 took effect November 26, 2003. Construction projects with plans submitted prior to 11-26-03
may continue to comply with the requirements of the "old" Rule. Construction projects with plans filed after November
26, 2003 must meet the requirements of the revised Rule 5.
One of the major changes to the Rule requires construction projects that are one acre or larger to comply with the new
requirements. This change requires small commercial, residential and agricultural projects to be regulated by this Rule.
Certain conservation projects are exempt from the Rule. Farm ponds, structures and/or manure waste facilities are
not exempt.
